• Kenexsoft Technologies: Refers to kenexsoft.com, the service provider.
• Customer: Refers to the individual or entity engaging Kenexsoft’s services.
• SOW: Statement of Work, a document outlining the specifics of the services to be provided.
• Advance Payment: An upfront payment made by the Client prior to the commencement of services

Kenexsoft offers a comprehensive range of Software Development and IT Consulting services, with the specific scope and deliverables outlined in the respective Statement of Work (SOW) for each project. Our products and services predominantly pertain to software solutions. Consequently, delivery is typically executed through various methods, including deployment of files to client-designated servers or cloud accounts, contingent on the access provided by the client. Alternatively, we may deliver a compressed project folder via email or provide a download link accompanied by detailed deployment instructions. The specific delivery approach will be specified in the SOW for each project based on the IT services in scope. Once the project or its incremental integratable phase is completed (i.e. Developed, Integrated, Tested) as per the project plan and project schedule, the shipping would take upto 10 business days. SOW has specifics.

The pricing will be specified in the SOW for each project. The pricing is fundamentally categorized based on the project type which is basically of 2 types:
   – Fixed Bid: This model includes advance followed by phase wise payments at the beginning of each next phase of the project.  
   – Time & Material: This model includes advance followed by next set of payments at a certain frequency of time such as Bi-Weekly or Monthly, as per SOW

The  average pricing is as follows:

• Software Development Engineer is $49/Hr. 
• Software Test Engineer is $45/Hr.
• IT Infrastructure Engineer is $47/Hr.

As a general policy, advance payments made specifically for project initiation at or after the signing of the SOW are non-refundable, However, Kenexsoft will make reasonable efforts to process a full or partial refund of advance payment made by the client if the client requests cancellation of services within 10 business days from either the date of signing the SOW or the date of the advance payment made for the initiation of the project, whichever is later. To initiate a refund request, the client must submit a written notice (formal official email to  “helloATkenexsoft.com” by the appropriately designated client SPOC (single point of contact)) of cancellation within this 10-business-day period. Upon receipt of such notice, Kenexsoft will review the request and inform the client of the outcome, including the extent of any refund deemed feasible.

Either party may terminate the services under the terms outlined in the SOW with 2 months advance notification. In the event of termination, all outstanding payments for services rendered up to the date of termination must be settled.

Both parties agree to keep all confidential information disclosed during the course of the project confidential and not to use or disclose such information except as necessary to perform the services outlined in the SOW.

All intellectual property created during the course of the project remains the property of Kenexsoft until full payment for the services is received. Upon full payment, intellectual property rights as specified in the SOW will be transferred to the Client.

Kenexsoft’s liability is limited to the amount paid by the Client for the services. Kenexsoft is not liable for any indirect, incidental, or consequential damages arising from the use of our services.

These terms and conditions are governed by and construed in accordance with the laws of the jurisdiction in which Kenexsoft operates.

Kenexsoft reserves the right to amend these terms and conditions at any time. Clients will be notified of any significant changes.

Kenexsoft is committed to protecting your privacy. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal information.

Any disputes arising out of or in connection with these terms and conditions shall be resolved through arbitration in accordance with the rules of the relevant arbitration body in the jurisdiction in which Kenexsoft operates, before resorting to court litigation.

Clients agree to use our services in compliance with all applicable laws and regulations and to refrain from engaging in any prohibited activities as outlined in the SOW.

The services provided by Kenexsoft are offered “As Is” and “As Available” without any warranties of any kind, either express or implied.

Clients agree to indemnify and hold Kenexsoft harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or in connection with their use of our services.
